What can I do to help my attorney win my personal injury case?
Cases are won based on the strength of the evidence. Here are some things you can do to help your case to be as strong as possible:
Get the names, addresses and phone numbers of any witnesses.
Go to a doctor or hospital if you are injured. Oftentimes, symptoms won't even begin to be felt until days after the incident, when the injured person will wake up stiff and sore, or start experiencing headaches. Do not ignore these symptoms.
Make a detailed personal record about the incident as soon as possible, while it is still fresh in your mind.
Take pictures of any visible injuries as soon as possible, and throughout the healing process.
Follow your doctor's instructions to heal properly.
If you were involved in a car crash, and if you drive for an employer, your employer may have procedures that you should follow. If you are self-employed, your insurance policy may set out instructions. You need to follow those instructions, or your claim for coverage may be denied. It is a good idea to review your insurance policy before getting in a crash, so you know what the process will be. The following additional things would also be very helpful:
Get the other driver's name, address, date of birth, driver's license number, telephone number, insurance company name and policy number.
Get the name and badge number of the reporting police officer, and get the police report number.
Take several pictures (from different angles) of the damage to the vehicle before it is repaired.
Should I give the insurance adjuster a recorded statement on the telephone?
NO. No matter how nice the adjuster seems, remember that they are NOT on your side. They will look for any tiny thing in your statement to make you seem like a liar, and attempt to twist what you say to their advantage. Meanwhile, anything you say that is advantageous to your side of the story will be ignored or de-emphasized. Giving them a statement can only hurt your case.
How much is your fee?
I work on a contingency fee for personal injury cases. My fees for traffic matters vary, depending on the type of traffic issue. Fees for simple traffic matters start as low as $50.00.
What is a contingency fee?
Most personal injury attorneys work on what is called a "contingency fee" arrangement. This means that you do not pay us up front for our services. Instead, we keep a percentage of the total amount of the settlement, after we win your case. If we don't win your case, we don't get paid.
This arrangement allows people to hire an attorney to represent them, even when they could not otherwise afford to hire an attorney. The insurance industry is composed of vastly powerful, multi-billion dollar corporations that have armies of attorneys on their side. Without contingency fees, injured people could not hope to fight them.
